SFFF asks court to block the block grant law
3.26.15
SFFF asked the court today to block the block grant law just signed by the governor.
SFFF filed a motion today in Shawnee County District Court that SB7 be stayed both temporarily and permanently. The Constitution requires both adequacy and equity in funding our schools. The Supreme Court has ruled that the equity provisions were being violated and set forth the correct equity test: “School districts must have (1) reasonably equal access to (2) substantially similar educational opportunity (3) through similar tax effort.”
It is the state’s burden to show that this test has been met and SB 7 most certainly does NOT pass this test. We have asked that the court maintain the status quo for school funding until such time as the state can pass a constitutional fix that does not do more damage than good.
